When a person buys a thing or a service that he needs, he is a consumer. He is the direct and the last person who consumes goods and services. Exploitation of the Consumer – Exploitation of consumers is done in many ways –

  • Selling low and bad quality goods by shopkeeper.
  • Using wrong measures and weights by shopkeeper.
  • Selling things after the expiry date by the seller.

How and where can a complainant make complaint against protection of his rights and exploitation?
Answer:
Where to complain?
The Consumer Protection Act was passed in 1986 to protect the consumers from various unfair practices that are adopted by the producers or sellers. Consumer courts have been set up to hear the complaints of the consumers. Consumes can register his complaints in these courts as follows –

  • A complaint upto 20 lakhs can be filed in the District Consumer Forum.
  • A complaint for an amount from 20 lakhs to one crore can be filed in the State Consumer Commission.
  • A complaint for an amount more than one crore can be filed in the National Consumer Commission.
  • The consumer can appeal to the High Court after a period of 30 days.

How to file a complaint by the consumer?

  • The consumer can write his complaint on a plain sheet of paper and send it either by post or present it in the court through a representative or personally. There is no fees for it.
  • Complaint against the fake or defective goods or defect in service hired must be filed within a period of two years.
  • The complaint must have the consumer’s name, address, details of the complaint and details of the what the complaint wants. The bill/receipt etc. of the goods brought also must be attached.

A buyer must take care of the below given precautions while buying goods:

  • He should always take and preserve the receipt of the purchase of a commodity, while buying it and also keep the guarantee/ warranty card.
  • One should see the name, batch number, production or expiry date, price and name of the producer on the commodity while buying it.
  • One must also see whether the commodity has an ISI, Agmark, FPO and other standardization marks etc.
  • One must also take care that the measures or weights being used are standardized.
  • The weight of the packing must not be included in the weights of the product sold.
